Eastside man indicted on kidnap, first-degree assault charges in DV case

DOVER - A 61-year-old East Rochester man is facing close to 30 years in state prison after his indictment on a slew of domestic assault charges that allegedly caused severe injury to the victim.

Carroll Smith, of 119 Milton Road, is charged with two counts of second degrees assault, kidnapping and first degree assault in an Aug. 2 incident.

The most serious charge of kidnapping alleges Smith did knowingly confine his female partner with a purpose to "terrorize her by beating her, threatening her life, and harming her pet" and that she suffered serious injury including a fractured nasal bone, auricular hematoma, swelling and bruising.

Smith's other charges include two counts of second-degree assault and first-degree assault.

The September grand jury indictments were handed down July 20 and released on Wednesday.

An indictment is not an indication of guilt, rather that enough evidence has been gathered to warrant a trial.
