DOVER - The Cocheco Street bar where a Dover man was fatally shot last December will lose its liquor license for six days in January after a settlement was recently reached with the state's Liquor Commission in connection with overserving the night the shooting occurred.
The settlement, which does not refer to the shooting or any of the principals involved, was agreed to by Castaways Boathouse Restaurant and Tike Bar. The commission's Division of Enforcement found four violations for serving or selling "alcoholic beverage to an individual who was visibly intoxicated or who a reasonable and prudent person would know is intoxicated" and that they "failed to maintain an orderly premises."
The Attorney General's office in June concluded no charges would be brought against Justin Sabattis, 46, no hometown given, who was preparing to leave Castaways in his truck when Dover resident Raymond Eldridge was fatally shot when he entered Sabattis' vehicle from the passenger side.
The AG's report concluded the state couldn't prove beyond a reasonable doubt that it wasn't self-defense.
Police first responded to Castaways around 10 p.m. on Dec. 18, the date of the liquor violations, in response to a complaint of a man brandishing a handgun. When police arrived they found Eldridge, 34, outside the restaurant lying by a pickup truck, the report said.
Both men were armed with handguns they legally possessed.
The Liquor Enforcement's punitive action includes the suspension of the bar's liquor license from Jan. 6-12 and a $3,000 fine, with $1,500 suspended if the bar remains on good behavior for a year.
The bar also faces an additional three days of closure if they have any overserving infractions in the next 12 months.
Finally the agreement orders that Randy Kilty and Stacy Day of Castaways attend a Management Training Seminar in a classroom within 30 days from the date of the agreement.
