ROCHESTER - Police say the Rochester man who picked up and threw a dog against the wall last month was angry because the dog had just made a mess on the floor.

“He’d had an accident,” said Rochester Police Captain Paul Toussaint on Monday.

Rochester police arrested Anthony Lane, 38, of 178 Jamey Drive, on July 19 and charged him with animal cruelty in connection with the July 9 attack on Pepper, a small, mixed-breed dog who weighed less than 15 pounds, Toussaint said.

After the dog was thrown he yelped and ran away, but apparently suffered no serious injuries, Toussaint added.

Lane lived at the house where Pepper lived, but police aren’t sure if he was the owner.

The crime of Cruelty to Animals is a Class B Misdemeanor for the first offense and a Class B Felony for the second or subsequent offenses of this type.

Lane was bailed on $2,500 PR bail and is scheduled to appear for arraignment later this month at the 7th Circuit – Rochester District.
