Montgomerys indicted on assault, fraud charges as search for Harmony goes on

CONCORD - The parents of Harmony Montgomery have been indicted by the Hillsborough County Grand Jury on charges that were initially brought in January, according to a joint statement from the Attorney Generals Office and Manchester Police.

Adam Montgomery, 30, was indicted on one class B felony charge of Second Degree Assault, alleging that between approximately July 1 and July 22, 2019, at Manchester, he knowingly caused bodily injury to Harmony, then 5, a child under the age of 13, by striking her in the face. As a class B felony, Second Degree Assault typically carries a maximum prison sentence of 3½-7 years; however, in this case the maximum prison sentence is 10-30 years due to the victim being under 13 years of age.

Kayla Montgomery, 31, was indicted on one class A felony charge of Theft by Deception, alleging that between approximately November 30, 2019, and June 2, 2021, at Manchester, pursuant to one scheme or course of conduct, she obtained or exercised control over property of another by deception and with a purpose to deprive him thereof, said property having a value in excess of $1,500. Specifically, the indictment alleges that on various occasions between approximately November 30, 2019, and June 2, 2021, Kayla Montgomery represented to NH DHHS that Harmony was a member of her household despite her not being so during that time period, resulting in her receiving benefits for Harmony in excess of $1,500 for that time period. As a class A felony, this charge carries a maximum prison sentence of 7½-15 years.

Both cases are next scheduled for dispositional conferences at the Hillsborough Superior Court Northern District in Manchester. Kayla Montgomery's case is scheduled for 10 a.m. on April 7, and Adam Montgomery's case is scheduled for 9 a.m. on June 28. Both Adam and Kayla Montgomery are currently incarcerated at the Hillsborough County House of Corrections.

The investigation into the disappearance of Harmony Montgomery recently narrowed to the time frame of Nov. 28-Dec. 10 of 2019, when Adam and Kayla Montgomery, together with their two common children and Adam's daughter Harmony, were evicted from 77 Gilford St. in Manchester on Nov. 27, according to police.

Multiple individuals have reported seeing Harmony with Adam and Kayla in the following days; however, by around Dec. 6-10, 2019, Adam and Kayla apparently had only their two common children, and Harmony was no longer with them.

This information leads police to believe that it was sometime during this window of approximately Nov. 28-Dec. that Harmony Montgomery disappeared.

Witnesses have reported that during that time, Adam, Kayla, and the children were homeless and living out of cars, possibly in the North End of Manchester. One of the cars was a silver 2010 Chrysler Sebring, and the other was a dark blue 2006 Audi S4.

The search for Harmony Montgomery continues, and officials request the public's assistance with locating her. Anyone with information regarding her disappearance or current whereabouts is asked to call the Manchester Police Department's 24-hour Harmony Montgomery tip line at (603) 203-6060.

The charges and allegations against Adam and Kayla Montgomery are merely accusations, and both are presumed innocent unless and until proven guilty.

An indictment is not an indication of guilt, rather that enough evidence has been gathered to warrant moving forward to trial.
